1.
Each Party shall ensure that its laws, regulations, procedures and administrative
rulings of general application respecting any matter covered by this Agreement are
promptly published or otherwise made available in such a manner as to enable
interested persons and Parties to become acquainted with them.
2.
Each Party shall:
(a)
publish in advance any such measure that it proposes to adopt; and
(b)
provide such interested persons and Parties a reasonable opportunity to
comment on such proposed measures.
3.
The obligations of paragraph 2 may be suspended in cases involving the national
security or foreign policy of a Party or where a Party for good cause finds that it
cannot comply with such obligations because compliance is impracticable in which
case the Party shall include the finding and the reasons for such finding in the
measure adopted. For the insurance sector, such obligations may be suspended for
reasons of national security, foreign policy, or where the Party for good cause finds
that such measures must be adopted when dictated by an emergency, including
circumstances affecting public health and welfare.
4.
In a case where the obligations of paragraph 2 have been suspended, a measure will
enter into force for no more than xx days, and interested persons and Parties shall be
provided a reasonable opportunity to comment on such proposed measure during the
xx day period.
